Does a Background Check Show Marital Status? How to Find Out If Someone Was Married Before (India 2026)

Court papers and chai on a Delhi family table as a mother checks whether a match was married before

Quick Answer

No, an ordinary background check in India does not show marital status, because there is no public, searchable marriage database. A previous marriage is found by piecing together marriage registration records, court cases such as divorce or maintenance petitions, documents the person holds, and discreet inquiries in the neighbourhoods and communities where they lived before.

Key Takeaways

  • India has no central marriage registry you can search by name, so “marital status” never appears in a standard ID or employment check.
  • The best traces of a past marriage are court records (divorce, maintenance, domestic violence cases), registration at the SDM office, and people who knew the person at an earlier address.
  • “Divorced” is a claim you can verify. Ask for the decree, then check the case number on eCourts.
  • Under Section 82 of the Bharatiya Nyaya Sanhita, marrying again while a spouse is living can mean up to 7 years in jail, and up to 10 if the first marriage was concealed.
  • A criminal case after the wedding is slow and uncertain. Checking before the roka is far cheaper.

The phone call usually comes two or three weeks after the wedding. A mother in Mayur Vihar, voice very steady, the way people sound when they’ve already cried. “A woman came to the house today. She says she’s his wife.” Then the question I’ve heard more times than I’d like: “How did nobody know?”

Nobody knew because nobody checked, and because checking a person’s marital history in India is genuinely harder than most families assume. There’s no website where you type in a name and see “married” or “single”. So families glance at LinkedIn, call one reference and move on. Here’s what a background check can and can’t tell you about a previous marriage, where the real records sit, and what you can safely check yourself.

Does a background check show marital status in India?

Not by default. A standard employer-style check confirms identity, address, education and employment. Marital status isn’t part of it, because no government database records it in a form the public can search.

Lawyers answering this exact question on legal-advice forums say the same thing plainly: there is no official website in India that publicly displays an individual’s marital status (LawRato). Aadhaar, PAN and driving licences don’t carry it. Voter lists don’t either.

A matrimonial background check can establish it, but only by building a picture from several sources.

Why is a previous marriage so easy to hide in India?

Three reasons, and none of them is that people are unusually dishonest.

Registration is patchy. The Supreme Court ordered compulsory registration of all marriages back in 2006 in Seema v. Ashwani Kumar, and Delhi issued its Compulsory Registration of Marriage Order in 2014. Yet in March 2025 the Delhi High Court called the non-implementation of that order “appalling” while hearing a PIL that asked, among other things, for a centralised marriage database (LiveLaw). Plenty of temple, gurdwara and home weddings were simply never registered.

Records are local. In Delhi, marriages are registered at the SDM office of the district where either spouse lives (Delhi Central District). A marriage registered in Ghaziabad, or in a hometown in Bihar or Punjab, won’t show up anywhere in Delhi.

Only one route has a public notice. Under the Special Marriage Act, a notice goes up on the registrar’s board and anyone can object within 30 days. Registration under the Hindu Marriage Act carries no such notice, according to the same district page. Most Hindu, Sikh, Jain and Buddhist marriages leave a much quieter paper trail.

“Families assume a first marriage leaves a big footprint. Usually it’s a small one in the wrong city. The work is finding which city, and which court building.”

Where does a previous marriage actually leave a trace?

No single source settles the question. Four or five together usually do.

Source What it can reveal The catch
District court records (eCourts)Divorce, maintenance, restitution or domestic violence cases filed by or against the personName spellings vary, and you need to know which district to search
Marriage registration (SDM office)A registered earlier marriageMany marriages were never registered, and records aren’t publicly searchable
Divorce decreeProof the marriage ended, the date, and the courtOnly useful once you confirm it’s genuine and final
Passport (last page)A spouse’s name, if one was declaredOnly as current as the last reissue, and you can only see it if they show you
Community and religious recordsNikahnama, church register, Anand Karaj recordsHeld locally; access depends on goodwill
Earlier addresses and neighboursWho lived with them, and whenNeeds discreet, in-person inquiry
Old matrimonial profiles and social mediaEarlier profiles listing “divorced”, old wedding photos, tagged in-lawsEasy to delete; a lead, never proof

The single most productive source, in our experience, is court records. People hide weddings. They find it much harder to hide a maintenance petition that has been listed for two years at Karkardooma or Saket.

How can you check someone’s marital history yourself? A 6-step method

You can do a fair amount without hiring anyone. Do it before the roka, while questions still feel normal.

  1. Ask directly, and write down the answer. “Has there been any earlier marriage or engagement?” is a fair question in an arranged match. Note the exact words. Vague answers matter later.
  2. Collect every address from the last ten years. Hometown, college city, job cities. This tells you which court districts to search.
  3. Search district court records by party name. The government’s eCourts services let you search district court case status by party name, state and district (National Portal of India). Try spelling variants, the father’s name and every district on your list.
  4. If they say “divorced”, ask for the decree. A genuine family will hand over a copy without drama. Check the case number and parties against the court’s online record.
  5. Look at the documents they offer. A passport’s last page has a field for the spouse’s name. Treat an old passport with an earlier name on that page as a question, not a verdict.
  6. Check old digital footprints. Archived matrimonial profiles, wedding photos from five years ago, an “ex-bhabhi” in a cousin’s friend list. These are leads only.

What you shouldn’t do: call their old employer pretending to be someone else, ask a friend in the police to “run a name”, or log into anyone’s account. That’s where a family’s honest worry turns into a legal problem of its own.

“If an eCourts search shows a petition between two people with the same surname, that’s not proof. It’s an address. Our job starts there: who filed it, where, and whether it ended.”

“Divorced” or “divorce pending”? The claim to test hardest

The outright hidden first wife is rarer than people think. Far more common is a softer version: a match described as “divorced” when the case is still running, or when only a mutual-consent petition has been filed.

The difference is legal, and it’s big. Under Section 11 of the Hindu Marriage Act, a marriage that breaks the one-living-spouse rule in Section 5(i) is void. And under Section 15, a divorced person can lawfully remarry only once the time for appeal has run out without an appeal, or an appeal has been dismissed. A decree that’s under appeal isn’t the end of the first marriage.

So when you see a decree, check three things:

  • The court and case number match the eCourts record.
  • The decree date, and whether any appeal was filed afterwards.
  • Whether any connected cases (maintenance, custody, domestic violence) are still pending. These often tell you more about the real story than the decree itself.

What does the law say if a first marriage was hidden?

Section 82 of the Bharatiya Nyaya Sanhita, 2023 (which replaced IPC Section 494) punishes marrying again while a husband or wife is living with up to seven years’ imprisonment and a fine. If the person also concealed the former marriage from the new spouse, the maximum rises to ten years (BNS Section 82, bare text).

That sounds decisive. In practice, courts look hard at the facts. In September 2026 the Madras High Court granted anticipatory bail to a woman accused of bigamy, holding that Section 82 targets the person who already has a living spouse, not a partner who didn’t know about it (Verdictum). In August 2026 the Chhattisgarh High Court quashed a cheating and bigamy case where the dates of the second marriage were disputed, noting that non-disclosure of a previous marriage doesn’t by itself amount to cheating without dishonest inducement (Legal Services India).

The law can help you. But a criminal case after the wedding means years of hearings, disputed dates and evidence fights. A few weeks of checking before the engagement costs a fraction of that, emotionally and financially.

“I’ve never met a family who regretted asking for a divorce decree. I’ve met many who regretted being too polite to.”

How does a detective find out if someone was married before?

A professional check works through the same sources thoroughly, with field staff who can go where a family can’t easily go without being noticed. A typical pre-matrimonial investigation in Delhi that focuses on marital history runs like this:

  1. Brief: we take the profile, every address and every claim the family made.
  2. Record searches: court records in each relevant district, plus public records and old online profiles.
  3. Field inquiries: discreet conversations near earlier addresses, workplaces and the community the person belongs to. Nobody announces who’s asking.
  4. Verification: any decree or certificate the family produced is checked against its source.
  5. Report: what we confirmed, what we couldn’t, and how confident we are in each point.

For a subject who has lived only in Delhi NCR, this usually takes about 7 to 12 working days. Add more time if there are hometown or overseas addresses. As an indicative range, a focused marital-history check starts around ?15,000 to ?25,000 and rises with each extra city; the final figure depends entirely on the case. Our guide to pre-matrimonial investigation cost breaks down what drives the price. Families in Shahdara, Dilshad Garden and the rest of East Delhi can meet our team at the Dilshad Garden head office.

Marital history is one item on a longer list. If you want the full picture of a groom’s job, income and family, our groom background verification checklist covers the rest, and this overview of what a matrimonial background check reveals shows how the pieces fit together.

Does this apply to brides and NRI matches too?

Yes. The method is identical for a bride. NRI matches are harder because the earlier marriage, or the divorce, may have happened abroad. A US or Canadian divorce, for example, leaves a record in that country’s courts, not in Indian ones. That’s why we search both countries; our NRI groom verification guide explains how cross-border checks work.

Frequently Asked Questions

Does a background check show marital status in India?

A standard background check doesn’t. India has no public database that records marital status, and ID documents like Aadhaar and PAN don’t show it. A matrimonial background check can establish it by combining court records, marriage registration, documents the person holds and discreet inquiries at earlier addresses.

How can I find out if someone was married before in India?

Start by asking directly and noting the answer. Then collect every address from the last ten years, search district court records by party name on eCourts for divorce or maintenance cases, and ask for a divorce decree if they say they’re divorced. For a reliable answer, a professional check adds field inquiries and record verification.

Is there an online marriage registry in India?

No public one you can search by name. Marriages are registered locally, in Delhi at the SDM office of the relevant district, and many marriages were never registered at all. In March 2025 the Delhi High Court heard a PIL seeking a centralised marriage database, but no such searchable public registry exists today.

How do I verify a divorce decree?

Note the court, case number and parties on the decree, then check them against the eCourts case record for that district. Confirm the decree date and whether any appeal was filed afterwards, since a decree under appeal doesn’t end the marriage. Also check for connected cases still pending, such as maintenance or custody.

Can a detective find out about a secret marriage?

Often, yes. Investigators search court records across every district the person has lived in, verify documents against their source, and make discreet inquiries with neighbours and community contacts at earlier addresses. Unregistered marriages are harder, but people rarely hide them from everyone who knew them. A lawful detective will never use phone tapping or hacking to do it.

What is the punishment for hiding a first marriage in India?

Under Section 82 of the Bharatiya Nyaya Sanhita, marrying again while a spouse is living can be punished with up to seven years’ imprisonment and a fine. If the first marriage was concealed from the new spouse, the maximum rises to ten years. Under the Hindu Marriage Act, such a second marriage is also void.

How long does a marital history check take?

For someone who has lived only in Delhi NCR, a focused marital-history check usually takes about 7 to 12 working days. Each additional city, especially a hometown in another state, adds time. If the person has lived abroad, expect longer, because records in that country have to be searched as well.

Ask the awkward question before the pheras

Most matches turn out exactly as described. Checking simply means your family’s biggest decision rests on facts, with politeness kept for the wedding itself. Ask the direct question. Ask for the decree. Search the courts in every city they’ve lived in. And if the answers are vague, or you simply don’t have the time or the access to do it properly, talk to us in confidence before the roka, not after.
