Investigation After Marriage in India: 7 Situations That Call for Facts in 2027

Quick Answer

An investigation after marriage (often called a post-matrimonial investigation) is a lawful, discreet check on facts your spouse or in-laws may have hidden or misstated: a previous marriage, debts, income, property, habits or dowry-related pressure. In Delhi NCR most cases take one to three weeks, and the findings can support annulment, divorce or a police complaint.

Key Takeaways

  • Most post-wedding cases fall into seven patterns: a hidden marriage or child, debts, false income, dowry pressure, a double life, infidelity and an NRI spouse who goes quiet.
  • If your consent to the marriage was obtained by fraud, the Hindu Marriage Act gives you only one year from discovering it to seek annulment.
  • A lawful check uses court records, public registries, field verification and surveillance in public places. It never touches bank, telecom or Aadhaar data.
  • Indicative 2027 ranges (case-dependent, excluding GST): Rs 5,000 to Rs 15,000 for a records check, Rs 25,000 to Rs 1,00,000+ for a detailed case with field work.
  • Get facts first, then take them to a family lawyer. The order matters.

Six months after a wedding in Dwarka, a young wife finds an SMS on the family laptop: an EMI reminder from a lender she has never heard of, for a loan she didn’t know existed. She asks. Her husband says it’s an old matter, sorted. Two weeks later a recovery agent calls her father-in-law’s landline. Nobody at home will discuss it.

That’s how most of our post-wedding cases begin: one small fact that doesn’t fit, and a family that closes ranks when you ask. If you’re reading this ahead of 2027, you’re probably in that uncomfortable middle, married, uneasy and unsure whether you’re imagining things. Here’s what we see most often across Delhi NCR, what can lawfully be checked, and what it costs.

What is an investigation after marriage?

An investigation after marriage is a confidential fact-finding exercise carried out once the wedding has already happened. It differs from a pre-wedding check in one important way: you’re no longer deciding whether to marry. You’re deciding what to do about a marriage that exists, which means the findings may end up before a Family Court, so how the facts are gathered matters as much as what they show.

The client is usually the spouse, sometimes a parent. A post-matrimonial investigation in Delhi typically looks at identity and marital history, employment and income, debts and litigation, property, the in-law family’s background, and, where there’s real cause, day-to-day movements in public places.

Which situations make families call a detective after the wedding?

Seven patterns account for nearly everything that reaches our office in Dilshad Garden, and they overlap. A man hiding debts is often lying about salary too.

1. A previous marriage or a child comes to light

This is the one that does the most damage, and courts take it seriously. In August 2025 the Delhi High Court upheld the end of a marriage where the husband’s Shaadi.com profile said “never married” although he had a previous marriage and a child, and had also misstated his salary. The court said such concealment “strikes at the very core of free and informed consent”, making the marriage voidable under Section 12(1)(c) of the Hindu Marriage Act. The original case had been decided by a family court in Rohini.

It cuts both ways. In July 2026 the Bombay High Court refused maintenance to a woman who had concealed her own subsisting first marriage, holding that a party can’t take advantage of their own wrong. Marrying again while a spouse is alive is also an offence under Section 82 of the Bharatiya Nyaya Sanhita, 2023.

Investigators trace marital history through court records in the cities a person has lived in, community and neighbourhood enquiries, and old addresses. We’ve explained the method in detail in our guide on how to find out if someone was married before.

From the field: Gaurav Aggarwal

“The word to test is ‘divorced’. A divorce that’s ‘almost final’ or ‘only on paper’ usually means a petition is still pending somewhere, often in another state. People rarely lie outright. They round off.”

2. Debts, loans or a salary that doesn’t add up

A spouse may be carrying personal loans, card debt, a failed business or a cheque-bounce case under Section 138 of the Negotiable Instruments Act. Generally you aren’t personally liable for a loan your spouse took alone unless you signed as co-borrower or guarantor, but confirm that with your lawyer.

What can be checked lawfully: whether the employer and designation are real, whether a claimed business is registered and active on the MCA portal, whether recovery suits or cheque-bounce cases appear in district court records, and whether lifestyle matches stated income. What can’t be checked: bank statements, loan accounts or a credit report without the person’s consent. If you want to see a credit report, ask your spouse to download and share their own. Their answer tells you something too.

3. Dowry demands and pressure from in-laws

This isn’t rare and it isn’t old-fashioned. India registered 15,489 cases under the Dowry Prohibition Act in 2023, up from 13,479 in 2022, and 6,156 dowry deaths, according to NCRB’s Crime in India 2023 data.

If you’re in danger, call 112 first, and the women’s helpline 181. An investigator isn’t a substitute for the police. Where one helps is in the background work a lawyer will need: whether an earlier daughter-in-law left the same family and filed complaints, whether the in-laws have prior litigation, and whether the family’s claimed status and income were accurate when the match was made. Cruelty by a husband or his relatives is now dealt with under Section 85 of the BNS (the old Section 498A IPC).

4. Habits, addictions and a double life

Late nights explained as “client dinners”. Cash that disappears. A second phone. Discreet surveillance, limited to public places, can establish where someone actually goes after office hours in Connaught Place, Cyber City or Sector 18, and with whom. We don’t diagnose anything. We report what was observed, with dates, times and photographs.

5. Suspected infidelity

People assume most post-wedding cases are about this. In our experience it’s one of seven. When the suspicion is specific, our infidelity investigation team runs it as a separate, surveillance-led assignment. We’ve written a full breakdown of how an extramarital affair investigation works, step by step, so we won’t repeat it here.

6. Property, assets and the “family business”

Ancestral land in Haryana. Two flats in Noida. A family firm with “crores of turnover”. Claims about property and business are among the easiest to make during a match and among the easiest to check afterwards. Professional asset verification tests ownership through land and registration records, site visits and local enquiries, and also shows whether a property is mortgaged, disputed or simply someone else’s.

7. An NRI spouse who goes quiet

A quick wedding, a few weeks together, a flight back to Toronto or Melbourne, then fewer calls and talk of “visa delays”. Indian-side checks (family property, Indian litigation) can be done from Delhi. Overseas employment and marital status need a partner on the ground, which adds time and cost.

From the field: Gaurav Aggarwal

“Families wait too long after the wedding. They think asking questions will break the marriage. What breaks it is the secret. The check itself is quiet, and most of the time the other side never knows it happened.”

What can a lawful check actually establish?

Here’s a realistic picture of each situation. Timelines assume the subject lives in Delhi NCR; anything outstation or overseas takes longer. Costs are indicative 2027 ranges, case-dependent and excluding GST.

How does a post-wedding investigation work, step by step?

  1. Confidential consultation. You tell an investigator, in person or by video, what you know and suspect. Bring the biodata, matrimonial profile screenshots and anything you lawfully hold.
  2. Scoping and a written quote. We tell you which questions can be answered lawfully and which can’t. If an agency promises call records at this stage, walk out.
  3. Desk research. Court, company and property records come first. It’s cheaper than field work and often settles the question.
  4. Field verification. Investigators visit claimed workplaces, addresses and properties, and make discreet enquiries. For subjects based in Gurugram’s corporate belt, our team in Gurugram handles the ground work.
  5. Surveillance, only if justified. Limited to public places, planned around known routines, and documented with dates and times.
  6. Report and debrief. You receive a written report with sources, photographs and a clear line between what was verified and what remains unconfirmed. Then we talk it through, ideally with your lawyer present.

From the field: Gaurav Aggarwal

“Don’t confront anyone until the report is in your hands. The moment a spouse senses a question, papers disappear and relatives start repeating the same story. Quiet first, conversation later.”

What can you do with the findings: annulment, divorce or a complaint?

That depends on what was found and how quickly you act. Under Section 12(2)(a) of the Hindu Marriage Act, a petition to annul a marriage for fraud must be filed within one year of discovering the fraud, and Section 12(2)(b) bars it if you knowingly kept living together as husband and wife after finding out. So a slow, half-hearted enquiry can cost you a legal option.

Other findings may support divorce on grounds such as cruelty, a maintenance claim, a property dispute or a criminal complaint for bigamy, cheating or dowry harassment. Your lawyer chooses the route; our job is evidence that survives scrutiny. If court use is likely, read our explainer on what makes detective evidence admissible in an Indian court before you start.

Legal & ethical note: what no detective should do for you

Alliance works only within Indian law: the right to privacy under Article 21 of the Constitution, the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, the Bharatiya Nyaya Sanhita, 2023 and the Bharatiya Sakshya Adhiniyam, 2023. That rules out phone tapping, spyware on a spouse’s phone, hacking email or WhatsApp, and any attempt to obtain call records, bank statements, Aadhaar or telecom data. Evidence gathered that way can get you prosecuted.

India also has no licensing law for private investigators yet. On 31 July 2026, in Himanshu Chordia v. State of Rajasthan, the Supreme Court flagged the absence of a regulatory framework for private investigators and sent its judgment to the Law Ministry and the Law Commission. Until a law arrives, judge an agency by its track record and its willingness to say no. Our guide to the legality of hiring a private detective in India covers the rules in full.

Frequently asked questions

What is a post-matrimonial investigation?

It’s a confidential investigation carried out after the wedding to verify facts a spouse or in-laws may have hidden or misstated, such as a previous marriage, income, debts, property, habits or dowry-related conduct. It uses court and public records, field verification and lawful surveillance in public places, and ends with a written report you can share with your lawyer.

Can I hire a detective after marriage in India?

Yes. Hiring a private detective is legal in India, provided the investigation itself stays within the law. A detective can verify records, visit addresses and observe public behaviour. A detective can’t tap phones, install spyware, hack accounts or obtain bank, telecom or Aadhaar data. Any agency offering those shortcuts is exposing you to legal risk.

How long does an investigation after marriage take?

For a spouse who has lived only in Delhi NCR, a records-based check usually takes five to fifteen days. Cases involving surveillance run one to three weeks, depending on how often the relevant behaviour happens. Outstation or NRI checks can take two to five weeks, because overseas records and partners add time.

How much does a post-marriage investigation cost in Delhi?

Indicative 2027 ranges, case-dependent and excluding GST: Rs 5,000 to Rs 15,000 for a basic records check, Rs 25,000 to Rs 1,00,000 or more for a detailed case with field work, and Rs 6,000 to Rs 20,000 per surveillance day. Overseas work is quoted separately. Ask for a written quote before work starts.

Can a marriage be annulled if my spouse hid a previous marriage?

Often, yes. If a first marriage was still subsisting, the second marriage is void under Section 11 of the Hindu Marriage Act. If a past marriage or child was concealed to win your consent, the marriage may be voidable for fraud under Section 12, but you must file within one year of discovering it. Take legal advice promptly.

Can a detective check my husband’s bank account or loans?

No. Bank statements, loan accounts and credit reports are protected, and no private investigator can lawfully obtain them without the account holder’s consent. A detective can check whether recovery suits or cheque-bounce cases appear in court records, whether a claimed business is registered, and whether lifestyle matches stated income. Your lawyer can seek financial disclosure through the court.

Will my spouse or in-laws find out about the investigation?

A professional team works to avoid detection. Records checks leave no trace with the subject, and field enquiries use neutral pretexts that don’t involve impersonating officials. Surveillance carries some risk of being noticed, which is why it’s planned carefully. The bigger risk is usually the client, so keep the matter to yourself until the report arrives.

Facts first, then the hard conversation

Plenty of marriages survive the investigation. Sometimes the debt is smaller than feared, or the “first marriage” was a broken engagement. Sometimes it’s worse. Either way you stop guessing, and the next decision (talk, counselling, mediation or court) rests on facts, not fear.
